Constitution of Moot Court Society

RAMAIAH COLLEGE OF LAW SOCIETY OF MOOTERS

PREAMBLE


  • The Ramaiah College of Law (RCL) “Society of Mooters” shall be the official body of the Ramaiah College of Law in all matters concerning moot courts.pain
  • The main purpose of the Society of Mooters shall be to put in place a proper framework in selecting and training the participants for various national and international moot courts to represent the Ramaiah College of Law.
  • The Society of Mooters shall also organize various intra college, inter college moot courts, client counseling and other legal competitions hosted by the Ramaiah College of Law.
  • The Society of Mooters shall strive to conduct all its affairs in a completely transparent and unbiased manner. It shall endeavor to contribute positively to bring more laurels to Ramaiah College of Law going forward.
  1. Committees: The M.S.R.C.L Society of Mooters shall primarily be comprised of the following two committees:
    • The Governing Committee
    • The Executive Committee.
      1. The Governing Committee:The Chairman, the Faculty Coordinators and the five student members assisting the faculty in charges will constitute the governing committee. The committee will be responsible for the overall functioning of the moot court society.
        The five students in the Governing Committee shall continue to hold their position in his/her capacity until such a time as the Chairperson in consultation with Faculty Coordinators deems fit.
      2. The Executive Committee:It shall be a committee appointed by the Governing Committee.
        The executive committee will have two members (except the final year students) from each year for the smooth functioning and conducting meetings for the society.
  2. Members: The following students who have participated in the intra-moot court competition or being exempted from the competition due to participation in moot courts at national and international competitions are deemed to be the members of the society.
    The members shall remain in their capacity till the day the annual M.S.R.C.L intra college moot court competition is held the following year.

    1. Chairperson: It shall refer to the principal of the Ramaiah College of Law.
      The Chairperson shall always continue to be the member of the Society of Mooters.
    2. Faculty Coordinators: It shall refer to the members of the teaching faculty at Ramaiah College of Law. They shall be appointed by the Chairperson to supervise and assist the working of the Society of Mooters.
    3. Executive Committee members: It shall refer to the members of the Executive committee, which will be formed before any competition is organized by the Society of Mooters. The Executive Committee may also include students who are members of the Society of Mooters in their individual capacities.The Executive Committee may form further sub committees, for division of the work that has been assigned to it, under the guidance of the faculty-in-charge.The members of the Executive Committee shall continue in their capacities until the event for which the committee is formed is completed entirely.
  3. Selection of the members of the Governing Council: The selection of the five students to the Governing Council shall take place in the following manner.
    The chairperson, in consultation with the faculty coordinators, shall select five students from among the final year students who have represented the college at various national and international level moot court competitions and has diligently assisted in the organization of programs/competitions organized by the Moot Court Committee.
  4. Meetings: There shall be a General Body meeting for the members of the Society of Mooters for at least twice every month.
    The membership of the student shall be withdrawn if the minimum attendance criteria are not satisfied.
    However in the event of reasonable causes not to hold it, the meeting may be dispensed with.
  5. Intra-college Moot Court: Every year at the beginning of the odd semester an intra-college moot court competition shall be organized.
    Participation in this moot court competition shall be mandatory for first year students and the students wishing to take part in any moot court competition outside the Ramaiah College of Law.
    Out of all the students participating, a specific number of students shall be shortlisted as being eligible.
    The rankings awarded in the intra-college moot court shall be in place till the intra-college moot court competition is organized the following year.
  6. Functioning of the Society of Mooters: The following shall be a guide to the functioning of the Society of Mooters.
    • At the beginning of every academic year, the Governing Committee shall compile a list of all the major upcoming moot courts in the following year.
    • Each student shall be allowed to participate in two moot court competition per semester subject to approval of faculty Coordinators.
      A student shall attend the screening and participate in the second moot only after the completion of the pending moot.
    • In the event, two or more members interested in participating in the same moot court competition, the team will be decided by the marks secured in the screening test. The decision of the Faculty Coordinators shall be final in this regard.
    • In the event where a team brings to the notice of the Governing Committee, a moot court competition that has not been listed in the calendar of upcoming moot courts, and wishes to participate in it, then they may be allowed to do so. The decision of the Governing Committee shall be final in this regard.
    • The Society shall also convey to all the members, in the General body meeting, the results of the recently concluded moot court competitions in which students of Ramaiah College of Law took part and also the details of students who will be taking part in upcoming moot court competitions.
    • The Society may make available to the participating students, books for research from the M. S. R. C. L library through a separate account.
    • When there is a moot court competition that is coming up and no teams which are eligible have signaled their intention, then a team which has already participated in a moot court competition for that semester and wishes to participate even in the present moot court competition, may be allowed to do so.
    • Furthermore, the Society shall always try and ensure that the provisions of this constitution are adhered to unless there are pressing reasons not to do so.
  7. Removal of members from their office: The student members in both the Governing committee and the Executive Committee, along with the members, can be removed from their positions if they are found to be functioning unsatisfactorily or are involved in activities that warrant a suspension respectively.The decision of the Chairman shall be final in this regard.
  8. Amendments: All the provisions in this constitution can be amended by the Faculty Coordinators with the assent of the chairperson.
  9. Residuary Clause:
    The residuary power lies with the Faculty Coordinators with the assent of Chairman with respect to any matter/issue/rule not enumerated in constitution of the moot court society.

MOOT COURT COMMITTEE RULES

Rules for representing RCL in National/International Moot Court Competitions

  1. The Moot Court Committee shall comprise of faculty coordinators. The Moot Court committee shall organize Intra-College Moot Court competition for an academic year for selecting members of the Moot Court Society.
  2. The members of the Moot Court Society shall only represent the college in national and international Moot Court Competitions, subject to the approval of the Moot Court Committee and the Principal.
  3. As a part of the selection procedure for individual competitions, the Moot Court Committee shall organize screening rounds for International/ National Moot Court Competition to select students to represent the college in the competitions. Students qualifying the screening rounds will be eligible to represent the college in the competitions.
  4. The Moot Court Committee shall decide International, National Moot Court Competition for participation by RCL students in an academic year based on the reputation of the competition. The committee shall shortlist three International Moot Court Competitions in an academic year. Students shall be allowed to participate in these listed competitions only, subject to the discretion of the faculty coordinators.
  5. International, National Moot Court Competition will be notified to the students by the student coordinators of the moot court society through announcement in classes and the same is displayed on the college moot court notice board.
  6. The students who are eligible shall register their name with faculty coordinator within the time as announced by the student coordinators of the Moot Court Committee within the time announced shall amount to waiver of their right to participate in the Moot Court Competition.
  7. The team selected after screening process to represent the college in a Moot Court Competition shall be under the guidance of the faculty member of the Moot Court Committee.
  8. The selected team must report/consult with the allotted faculty member for guidance and then prepare their memorials, subject to the satisfaction of the faculty member with the time prescribed by the faculty member.
  9. Any member of the selected team shall be replaced in case of poor performance in preparation for the Moot Court Competition on recommendations of the faculty members by the Principal.
  10. Confirmation of participation in the Moot Court Competition is subject to satisfaction of the faculty coordinators of the Moot Court Committee regarding the preparation of the team, without which the registration stands cancelled.
  11. The team registered to represent the college in a Moot Court Competition shall, under no circumstances, change its members without the approval of the allotted faculty members and the permission of the Principal.
  12. Students representing the college in National Moot Court Competition shall be reimbursed the expenses incurred for registration, memorial and travel, based on their performance in the respective moot court competitions by the college, upon application to the Principal to be forwarded through the faculty in charge of the team.
     

    Runners/ Winners = Registration Fee +  100%  of the expenses incurred
    Semi Finalists = Registration Fee +  75%  of the expenses incurred
    Best Memorial = Registration Fee +  50%  of the expenses incurred
    Quarter Finalist / preliminary round  = Registration Fee only

    [Expenses Incurred means travel expenses that are paid towards to and fro sleeper class train tickets and the memorial charges]
    [Travel expenses are paid towards the to and fro sleeper class train tickets. The memorial charges are paid at Re 1 per page for printing and Rs 50/- per copy for binding. No reimbursement for compendium, except in exceptional circumstances to be recorded in writing with the approval of the Principal].

  13. Students shall be eligible to represent the college in International Moot Court Competitions if they are from 4th and 5th year B.A.L.L.B and have participated in at least two National/international Moot Court Competitions subject to any screening process and to the discretion of the Principal.
  14. Students representing the college in international rounds of Moot Court Competitions/ Moot Court Competitions happening outside India shall be reimbursed the expenses incurred for registration only by the College. The expenses incurred for travel, accommodation and memorial charges will be borne by the students.
  15. The maximum number of moots that a student can participate in semester is been restricted to two exclusive of the ADR and Client Counseling Competitions.
  16. The Maximum number of days a student can incur exemption from the classes for participating in moot court competitions/ ADR Competitions shall not be more than 15 working days during a semester. The exemption given for each competition shall not exceed 7/8 days.
